Tuesday, April 21, 2009, is the moment that any chance of a new era of bipartisan respect in Washington ended. By inviting the prosecution of Bush officials for their antiterror legal advice, President Obama has injected a poison into our politics that he and the country will live to regret.
Policy disputes, often bitter, are the stuff of democratic politics. Elections settle those battles, at least for a time, and Mr. Obama’s victory in November has given him the right to change policies on interrogations, Guantanamo, or anything on which he can muster enough support. But at least until now, the U.S. political system has avoided the spectacle of a new Administration prosecuting its predecessor for policy disagreements. This is what happens in Argentina, Malaysia or Peru, countries where the law is treated merely as an extension of political power.
If this analogy seems excessive, consider how Mr. Obama has framed the issue. He has absolved CIA operatives of any legal jeopardy, no doubt because his intelligence advisers told him how damaging that would be to CIA morale when Mr. Obama needs the agency to protect the country. But he has pointedly invited investigations against Republican legal advisers who offered their best advice at the request of CIA officials.
“Your intelligence indicates that there is currently a level of ‘chatter’ equal to that which preceded the September 11 attacks,” wrote Assistant Attorney General Jay Bybee, in his August 1, 2002 memo. “In light of the information you believe [detainee Abu] Zubaydah has and the high level of threat you believe now exists, you wish to move the interrogations into what you have described as an ‘increased pressure phase.’”
So the CIA requests a legal review at a moment of heightened danger, the Justice Department obliges with an exceedingly detailed analysis of the law and interrogation practices — and, seven years later, Mr. Obama says only the legal advisers who are no longer in government should be investigated. The political convenience of this distinction for Mr. Obama betrays its basic injustice. And by the way, everyone agrees that senior officials, including President Bush, approved these interrogations. Is this President going to put his predecessor in the dock too?
Mr. Obama seemed to understand the peril of such an exercise when he said, before his inauguration, that he wanted to “look forward” and beyond the antiterror debates of the Bush years. As recently as Sunday, Rahm Emanuel said no prosecutions were contemplated and now is not a time for “anger and retribution.” Two days later the President disavowed his own chief of staff. Yet nothing had changed except that Mr. Obama’s decision last week to release the interrogation memos unleashed a revenge lust on the political left that he refuses to resist.
Just as with the AIG bonuses, he is trying to co-opt his left-wing base by playing to it — only to encourage it more. Within hours of Mr. Obama’s Tuesday comments, Senator Carl Levin piled on with his own accusatory Intelligence Committee report. The demands for a “special counsel” at Justice and a Congressional show trial are louder than ever, and both Europe’s left and the U.N. are signaling their desire to file their own charges against former U.S. officials.
Those officials won’t be the only ones who suffer if all of this goes forward. Congress will face questions about what the Members knew and when, especially Nancy Pelosi when she was on the House Intelligence Committee in 2002. The Speaker now says she remembers hearing about waterboarding, though not that it would actually be used. Does anyone believe that? Porter Goss, her GOP counterpart at the time, says he knew exactly what he was hearing and that, if anything, Ms. Pelosi worried the CIA wasn’t doing enough to stop another attack. By all means, put her under oath.
Mr. Obama may think he can soar above all of this, but he’ll soon learn otherwise. The Beltway’s political energy will focus more on the spectacle of revenge, and less on his agenda. The CIA will have its reputation smeared, and its agents second-guessing themselves. And if there is another terror attack against Americans, Mr. Obama will have set himself up for the argument that his campaign against the Bush policies is partly to blame.
Above all, the exercise will only embitter Republicans, including the moderates and national-security hawks Mr. Obama may need in the next four years. As patriotic officials who acted in good faith are indicted, smeared, impeached from judgeships or stripped of their academic tenure, the partisan anger and backlash will grow. And speaking of which, when will the GOP Members of Congress begin to denounce this partisan scapegoating? Senior Republicans like Mitch McConnell, Richard Lugar, John McCain, Orrin Hatch, Pat Roberts and Arlen Specter have hardly been profiles in courage.
Mr. Obama is more popular than his policies, due in part to his personal charm and his seeming goodwill. By indulging his party’s desire to criminalize policy advice, he has unleashed furies that will haunt his Presidency. |

We live in some dangerous times and I’m getting sick of hearing self-righteous liberals complain about torture. Here’s some thoughts for you liberals:
Picture yourself as Daniel Pearl as you see that knife come to your throat and feel the blade cut into your flesh and try to scream but manage only a gurgle as it slices through your muscles and arteries and veins and finally your spinal cord.
Picture yourself as one of the people on the floors above the destruction of the plane crashes in the WTC, feel the heat from the fires ignited by the jet fuel and realized you can’t make it to safety and your can’t be rescued before you burn to death, you stand on the ledge a hundred floors up struggling to get a breath of fresh air, and you look down and rather than burn to death you chose to jump knowing that it is certain death, you pray to God that you will black out before hitting the pavement far below.
Picture yourself as one of the passengers on one of those airliners that struck either the WTC or Pentagon that morning, the flight crew is dead or injured and terrorists have control of the plane, you noticed that you are flying so low that buildings are whizzing by like a picket fence and right before a turn you see the twin towers or the pentagon and in the next few seconds you realize that you are going to collide with a building and be killed instantly and will never see your family again.
Now picture yourself as President of the United States, prior to 9/11 you pray that you would never have to give the order to torture an enemy for information, but everything has changed now, you are conflicted between your morality and your oath to protect and defend this country. You can’t let anymore innocent Americans die in another terrorist attack and some of the enemy combatants captured in Iraq and Afghanistan are high ranking individuals in Al Qaeda. They have made statements that another attack is coming, you need more info and the only way you will get it is through enhanced interrogation techniques such as waterboarding, sleep deprivation, etc. The info you get this way proves valuable and you are able to stop attacks on other parts of the country, thousands of lives have been saved, and none of the enemy combatants that these techniques were used on, died or suffered serious or lasting injury.
My point is people have died terrifying, horrible deaths at the hands of these muslim terrorists while eventhough we used torture techniques, NOT ONE OF THESE ANIMALISTIC MURDERERS DIED!!!
I wonder what liberals would do if it was if they were faced with similar circumstances as Bush was, I have a feeling we will find out soon enough because obama can do as much sucking up to our enemies as he wants, it won’t stop them from hitting us again. Their hatred of us has nothing to do with who sits in the White House, it has everything to do with their hatred of America and our God, our freedoms and our prosperity, they will continue to hate us no matter what. Their domination over us is what they want and crave and when we show weakness is when we are the most vulnerable, so thank you obama, so far you have done your best to show weakness in the face of our enemies.

I have no choice but to agree with what you said, all of it. You describe quite well, what others experienced that terrible day. Innocent people going about their daily routines suddenly find themselves about to die is torture in my book. So If we have to apply some pain (hopefully lot’s of it) to get info that saves more innocent lives, then I say… “beat it out of them”.

Thank you. As Booyah would say, “you get it”. And you have described the situation of terrorism – from the viewpoint of the victims and of the Muslim terrorists – better than most Leftists could ever understand or imagine.
Because of who they are and what they believe, Leftists are some of the most ignorant people (other than Muslims) on the face of the earth. They have forgotten everything pertaining to common sense and personal freedoms – if they ever knew it in the first place. I only wish, and hope, that the next terrorist attack is on a Leftist award ceremony like the Oscars. That way many of the most vocal and vehemently stupid Leftists in the country could learn first hand what terrorism is and what it’s like to be a helpless victim. And in a place like the Oscars there would be a very high percentage of victims that are extremely ignorant Leftists.
I am not wishing an attack on anyone. But an attack is inevitable so why not take out the Leftist idiots that have no clue? It would certainly change the way that segment of our society views the efforts to keep them, and all of us, safe in our own country.

Personally, I think this whole issue is a distraction from the ongoing criminal activity occurring by the Obama Administration. Think about it, everyone is in a tizzy over a potential prosecution that quite frankly is patently absurd and illegal. You can’t prosecute an officer of the court (lawyer) for rendering a legal opinion. There is no legal precedent for doing so to my knowledge nor is there any law on the books under which a lawyer giving an opinion can be prosecuted.
What is really going on is a distraction from the securities fraud committed by Bernanke, Paulson and CEO of BofA, Lewis in the merger of Merrill Lynch and BofA. Under oath, Lewis testified that he was told to keep quite, withhold material information that affected the stock price of BofA from the stockholders of BofA. The merger negatively financially impacted the stock price and the financial health of the company (they had to receive TARP funds as a result), all three knew this but withheld that information. Had the information been released to the stockholders before the vote, the merger would never have been approved. Thus Lewis violated his fiduciary trust (a criminal offense) to tell the stock holders and Bernanke and Paulson engaged in a criminal conspiracy abusing their office to defraud the stockholders costing them billions of dollars. It matters not what Bernanke’s or Paulson’s intent, what they did was ILLEGAL.
Now combine this with the Freddie Mac CFO who prior to committing suicide was in a fight with “certain” government officials about reporting the disclosure of Obama’s program that cost them an additional $30 billion. Who are these officials that attempted to pressure the CFO to commit fraud in not reporting the $30 billion loss? Do you see the pattern here?
The Obama Administration is nothing more than a criminal enterprise by it’s behavior. Fraud is fraud, no matter who they are, whom they claim to represent or the rationalizations to commit this crime.
This goober cheese has to be impeached.

Having come to this blog after leaving the Fox News story of the high approval rating of the Arab in Chief (sorry, our first “black” president) his first 100 days, I can’t help but feel that many Americans are fat, dumb and happy, and their heads are firmly stuffed where the sun don’t shine. With the attention span of a rutibaga, it’s a wonder many can even remember how to tie their shoes. Oh, that’s right, there’s velcro.
This is not a productive response at all, but today I’m so frustrated I could scream. Come to think of it, I felt this way yesterday, too. And probably will tomorrow, and the next day . . . you get my drift. “Torture”, my Aunt Fanny!

Good grief, The Traitor is wasting no time in ensuring our country is attacked again. My God between this, allowing those “torture” photographs to be released to the ACLU, and releasing terrorists on our own soil, can he possibly do any more to endanger us? Please tell me this is a bad, bad dream…
I wonder why the American Civil Liberties Union isn’t assisting the multitudes of Americans trying to obtain proof that Hussein is actually of American birth? It would seem the “American” thing to do since it deals specifically with the American Constitution and the American president.
I guess America isn’t the America we Americans remember anymore.
